Trafficmind and its subsidiaries (“Trafficmind”, “we”, “us”, or “our”) are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, transfer, and safeguard personal data when you interact with us directly (for example, by visiting our offices, attending our events or meetings, or contacting customer support), when you use our websites, and when you use our products and services (collectively, the “Solutions”).

This Policy applies to Trafficmind websites and Solutions that link to or reference it, as well as to your direct interactions with us. It describes the types of personal data we process, the purposes for which we process it, and the choices available to you. Certain Solutions, features, or programs may present solution-specific privacy notices, data sheets, or offer descriptions at or before the time of collection; if a solution-specific notice conflicts with this Policy, that notice will control for that Solution. If there is any inconsistency among translated versions of this Policy, the U.S.-English version governs.

Personal Data We Collect

We collect personal data directly from you when you register for or log into an account, download software or materials, request information, apply for a job, visit our offices, or otherwise engage with our websites or Solutions. This may include identifiers and contact details such as your name, email address, phone number, postal address, and—where relevant to recruiting—education and employment history.

We also automatically collect certain internet and network information when you access our websites or Solutions, including IP address, login and authentication data, device and connection information (such as browser type and version, time-zone setting, operating system, and plug-ins), and information about how you interact with our websites and Solutions. If you enter a product identifier or similar code, we may associate it with applicable customer or account information.

We do not intentionally collect sensitive personal data (also referred to as special categories of data) to infer characteristics about you. We may process aggregated or de-identified information that does not identify individuals; for example, to analyze performance, improve our websites and Solutions, or produce statistical insights for us and our partners.

How We Use Personal Data

We process personal data only in ways compatible with the purposes for which it was collected or later authorized. Typical uses include providing, operating, maintaining, improving, and promoting our websites and Solutions; enabling access and authentication; processing transactions and sending related information such as confirmations and invoices; delivering service, technical, and security communications; providing customer support and resolving issues; complying with legal obligations and enforcing our agreements; investigating, preventing, and mitigating fraud, abuse, security incidents, and other illegal or harmful activity; and carrying out other uses with your consent where required.

Where permitted by law and consistent with your communication preferences, we may also send commercial communications about products, features, surveys, newsletters, promotions, events, and other news from Trafficmind and our partners. We analyze usage trends to understand how our websites and Solutions are used, to enhance user experience and performance, and to support our marketing, security, and product development activities. When you visit our offices, we may register visitors and manage non-disclosure agreements to protect our personnel, facilities, and confidential information.

If Trafficmind offers a public DNS resolver or similar network service, we use limited operational information to run and improve that service, including debugging and security. We do not combine DNS query data with other data in a way that identifies individual end users, and we retain only aggregated or de-identified information as necessary to enhance performance and identify threats.

We may also enrich business contact information we collect through our websites or sales forms with data from reputable third-party sources to maintain accurate records and tailor outreach to organizations that may benefit from our Solutions.

Data Aggregation and Analytics

Trafficmind may aggregate and de-identify data about visitors, customers, administrators, and end users to produce insights such as traffic statistics, performance metrics, and threat intelligence. Aggregated or de-identified information does not identify individuals and may be shared with third parties for legitimate business purposes.

When We Share Personal Data

We do not sell, rent, or lease your personal data. We share personal data only as described here or with your consent. We disclose personal data to our employees, contractors, consultants, and affiliates who need the information to provide or support the Solutions and who are bound by appropriate confidentiality and security obligations. We share data with trusted service providers who host and back up content; provide analytics, security, authentication, logging, and fraud prevention; operate our systems and networks; support marketing and business development activities; manage events; process orders, billing, and collections; and assist with legal, compliance, and professional services. We may share contact information with select partners to deliver joint or bundled offerings or to provide information that we reasonably believe may be of interest to you, consistent with your choices.

We disclose information when required by law or in response to valid legal process, including to public authorities for law enforcement or national security purposes, and when we believe in good faith that disclosure is necessary to protect rights, safety, or the integrity of our services. If Trafficmind is involved in a merger, acquisition, reorganization, or sale of assets, personal data may be transferred to the relevant parties, subject to appropriate protections.

International Information Transfers

Trafficmind is a Switzerland-based company operating globally. We primarily store personal information in Switzerland, but to support our worldwide operations we may transfer and allow access to that information from other countries where the Trafficmind group or our trusted service providers operate, for the purposes described in this Policy.

When personal information is transferred from one country to another—whether to another Trafficmind entity or to a third-party provider—we implement appropriate safeguards consistent with the laws of the exporting jurisdiction. These safeguards may include entering into standard contractual clauses (and any required UK or Swiss addenda), relying on adequacy decisions where available, and applying robust technical and organizational measures to protect the data. EU/UK/Swiss–U.S. Data Privacy Framework

TMN SA and applicable U.S. subsidiaries participate in and have certified compliance with the EU–U.S. Data Privacy Framework, the UK Extension to the EU–U.S. DPF, and the Swiss–U.S. DPF as administered by the U.S. Department of Commerce. If there is a conflict between this Policy and the DPF Principles, the DPF Principles govern for data transferred under the DPF. Under the DPF, individuals in the EU/EEA, UK (and Gibraltar), and Switzerland have rights to access, correct, amend, or delete personal information processed in the United States and to opt out of certain disclosures. Where applicable, you may request to opt out of disclosures to third parties or of processing for materially different purposes than those for which the data was collected. These rights may be subject to lawful exceptions. For DPF inquiries or complaints that remain unresolved, Trafficmind US commits to cooperate with EU, UK, and Swiss data protection authorities and, where applicable, to binding arbitration as described in the DPF Principles.

Data Security

We implement physical, technical, and organizational safeguards designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. We also require our service providers to protect personal data appropriately. No method of transmission or storage is completely secure; however, we continually work to improve our security controls and practices.

Children’s Privacy

We do not knowingly collect personal data from children without appropriate parental or guardian consent. If you believe we have collected personal data from a child contrary to applicable law, please contact us using the details below and we will investigate and take appropriate action.

Your Rights and Choices

Subject to applicable law, you may have rights to access, correct, update, port, or delete your personal data, and to restrict or object to certain processing. You can submit a request by emailing support@trafficmind.com. We will verify your identity before acting on a request and respond within the time required by law. If you act through an authorized agent, we may require proof of authorization and additional verification. Where a request may impact the privacy rights of others, we will balance the interests involved and comply to the extent required by law. Residents of certain jurisdictions, including Virginia and Colorado, may have the right to appeal a denied request by replying to our decision or emailing support@trafficmind.com; we will respond within the applicable timeframe. In the EEA, the UK, and Switzerland, you also have the right to lodge a complaint with your supervisory authority.

If we provide network-level services that do not retain personal data in identifiable form (for example, a public DNS resolver), requests described in this section may not apply to such data. Trafficmind’s customers remain responsible for their own websites and end-user data; if you are an end user of a Trafficmind customer, please direct requests to that customer. Where appropriate, we will notify the relevant customer.

You can manage marketing communications by using the unsubscribe links in emails or by contacting us. Even if you opt out of marketing, we may still send transactional or service communications.

Data Retention

We retain personal data as long as needed to fulfill the purposes for which it was collected, to comply with legal and regulatory obligations, to resolve disputes, to protect our assets, and to enforce our agreements. When personal data is no longer needed, we will delete, anonymize, or otherwise dispose of it securely.

Changes to This Policy

We may update this Policy to reflect changes in law, our practices, or our Solutions. Material changes will be posted on our websites and, where required, we will notify you by email or through the Solutions. Changes take effect when posted unless a later effective date is stated. Your continued use of the websites or Solutions after an update signifies acceptance of the revised Policy. If you do not agree, you should stop using the websites or Solutions and may request deletion of your data, subject to legal and contractual limits.

California Privacy Rights

California residents have rights under the California Consumer Privacy Act, as amended by the CPRA, including rights to request access to, correction of, and deletion of personal information; to opt out of certain sharing or “sales” of personal information; and to be free from discrimination for exercising these rights. You can exercise these rights via our cookie and privacy preference tools available in the website footer or by submitting a request through the Trafficmind Privacy Request Form or by emailing support@trafficmind.com. Your preferences are specific to each device, browser, and Trafficmind digital property. Trafficmind does not sell personal information as defined by California law and does not discriminate against individuals for exercising their privacy rights.
